On February 12 2003 the Russian Agency for Patents and Trademarks (Rospatent) passed a new resolution approving regulations for submission and registration of chip design layout (the "Regulations") (Order of the Russian Agency for Patents and Trademarks No. 26 dated February 25 2003). The Regulations replaced the previous regulations governing registration of chip design layout which have been in effect since 1993.

Under the Law on the Legal Protection of Chip Design the registration of chip design layouts is optional. Applications for registration may be filed by Russian physical or legal persons. Foreign nationals enjoy protection in accordance with the international treaties or on the basis of equality.

In the event that a chip design layout is in commercial use, the application for registration may be filed within two years after the first commercial use thereof.

The application should not be in respect of chips containing state secrets or other secrets protected by law.

Each application is filed only for one chip design layout and should include:
  • an application form (in the form prescribed by the Regulations), with details about the proprietor, the author, and the first financial use (if any);
  • identification materials, including two write-ups and four sample chips (in the form of their commercial use, if any);
  • evidence of payment of the registration fee.
The applicant may withdraw his application at any time before the registration of the chip design layout. The application details may also be altered before the details are published in the official bulletin on payment of an additional fee.

Rospatent may request additional details or clarification, or arrange for an oral hearing with the participation of the applicant.

Applications are considered by Rospatent within two months after they are submitted.

In the event of the positive decision by Rospatent, the details of the chip design layout are entered into the Register of Chip Design Layouts. The applicant is issued a notification of the official registration and the Certificate of Registration. The details of the registered chip design layout are then published in the official bulletin published by Rospatent.
